Terms and Conditions
By accessing and using FlutterbyKatie.com (the "Website") and/or purchasing artwork from COINN LLC d/b/a Flutter by Katie ("we," "us," or "our"), you agree to be bound by these Terms and Conditions.
Please read them carefully.
1. Product Information and Nature of Artwork:
This artwork consists of unique, handcrafted sculptures utilizing glass, wood, and natural organic materials. Due to the inherent nature of these materials and the artistic process:
- Variations: Slight variations in color, texture, size, and appearance may occur from the images displayed on the Website. Natural organic materials may exhibit natural imperfections and changes over time.
- Fragility: Glass components are fragile and should be handled with care. We are not responsible for damage caused by improper handling after delivery.
- Organic Materials: Natural organic materials may be subject to natural processes such as fading, cracking, or decomposition over time. This is a natural characteristic of the materials and not considered a defect.
2. Ordering and Payment:
Orders are subject to acceptance by us. We reserve the right to refuse or cancel an order for any reason, including but not limited to product unavailability or errors in pricing or description.
Prices are listed in USD and are subject to change without notice.
Payment is due in full at the time of purchase.
3. Shipping and Delivery:
We currently ship within the contiguous United States. Shipping costs will be calculated and displayed at checkout.
Delivery times are estimates and may vary depending on your location and shipping method. We are not responsible for delays caused by shipping carriers.
Risk of loss and title for purchased artwork pass to you upon our delivery to the shipping carrier. Please inspect your artwork upon arrival for any damage during transit and notify us within 24 hours of receipt.
4. Returns and Exchanges:
Due to the unique and often fragile nature of our artwork, we generally do not accept returns or exchanges unless the item was significantly misrepresented in its description or arrived damaged during shipping.
If your artwork arrives damaged, please contact the carrier and submit a claim for reimbursement. All artwork is shipped with insurance for it's full value. You will need clear photographic evidence of the damage to the artwork and the packaging. If you have any questions you think we can help answer, we can review the situation and determine an appropriate resolution, which may include a repair, or replacement (if possible). But the carrier will be responsible for any refunds.
For misrepresented items, please contact us within 24 hours of receipt to discuss the issue.
5. Intellectual Property:
All artwork designs, images, and content on this Website are the intellectual property of Flutter by Katie and are protected by copyright law. You may not reproduce, distribute, or modify any content from this Website without our prior written consent.
6. Limitation of Liability:
To the fullest extent permitted by law, Flutter by Katie shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your purchase or use of our artwork or this Website. Our total liability to you for any claim arising out of or relating to these Terms and Conditions or your purchase shall not exceed the purchase price of the artwork in question.
7. Governing Law and Jurisdiction:These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
Any legal action or proceeding arising out of or relating to these Terms and Conditions shall be brought exclusively in the state or federal courts located in Brooklyn, New York.
8. Changes to These Terms and Conditions:
We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on the Website. Your continued use of the Website and/or purchase of artwork after any such changes constitutes your acceptance of the new Terms and Conditions.
